1. Introduction

This agreement applies between you, the user (“User”, “you”) and Max Campbell, trading as Untide Sailing Club, a sole trader registered at Mylor Creek Boatyard, Tregatreath, Mylor Bridge, Falmouth, TR11 5NS, United Kingdom, United Kingdom (“we”, “us”, “our”).

By accessing, purchasing, or using our website, platform, or services, including the Untide Sailing Club community hosted on Skool, you agree to be bound by these Terms & Conditions. If you do not agree with these terms, you must not use our services.

2. Description of the Service

Untide Sailing Club is a digital, subscription-based online product that provides:

• Access to a video course consisting of 7 modules
• A toolbox including checklists and templates
• Access to a private online community hosted on the Skool platform

All content is delivered digitally. No physical products or in-person services are provided.

3. Eligibility

You must be at least 18 years old to use this service.
By purchasing or accessing the service, you confirm that you meet this requirement.

4. Subscription, Billing & Payment

• The service is offered as a monthly subscription.
• The current price is $35 USD per month, unless otherwise stated at the point of purchase.
• Subscriptions automatically renew every month until cancelled.
• Payments are processed via the Skool platform, which may use third-party payment processors such as Stripe.
• By entering your payment details, you authorize recurring charges according to the selected subscription plan.

We do not store or process payment details directly.

5. Cancellation & No-Refund Policy

Cancellation

You may cancel your subscription at any time before the next billing date via your Skool account settings.
After cancellation, access remains active until the end of the current billing period.

It is the user’s responsibility to manage and cancel their own subscription.

No Refunds

All payments are non-refundable.

Due to the digital nature of the service and immediate access to content and community resources, we do not offer refunds, whether partial or full, once payment has been processed.

6. User Responsibility, Experience-Based Content & No Guarantee of Results

All content provided within Untide Sailing Club is for educational and informational purposes only and is based on personal experience, general knowledge, and individual perspectives.

• We do not guarantee any specific results, outcomes, financial savings, successful purchases, or experiences.
• You are solely responsible for how you interpret, apply, and use the information provided.
• Any actions you take based on the content are taken entirely at your own discretion and risk.

Success, decisions, and outcomes depend on many factors outside our control, including your own judgment, skills, circumstances, and third-party services.

7. No Professional, Technical or Maritime Advice

Untide Sailing Club does not provide professional, technical, legal, financial, safety, or maritime advice.

In particular:

• Content is not a substitute for professional inspections, surveys, training, certifications, or expert advice.
• Nothing provided constitutes a recommendation or instruction to buy, sell, charter, operate, repair, or board any vessel.
• Any examples, explanations, or experiences shared are general in nature and may not apply to your specific situation.

You should always seek appropriate professional or technical advice before making decisions related to boats, equipment, travel, or safety.

8. Physical Activities, Boats & Third-Party Risk Disclaimer

Participation in boating-related activities, including but not limited to purchasing, chartering, operating, boarding, or travelling on a vessel, involves inherent risks, including physical injury, property damage, financial loss, or harm caused by third parties.

By using this service, you acknowledge and agree that:

• We are not responsible for any actions you take in the real world.
• We are not liable for accidents, injuries, damages, losses, or disputes arising from interactions with boats, equipment, sellers, charter companies, crew members, or other third parties.
• Any real-world decisions or activities are undertaken solely at your own risk.

9. Intellectual Property

All content provided within Untide Sailing Club, including but not limited to videos, templates, checklists, text, graphics, and community materials, is the intellectual property of Untide Sailing Club unless otherwise stated.

You may not:

• Copy, reproduce, distribute, resell, or share any content
• Grant access to non-members
• Use the content for commercial purposes

Access is granted for personal, private use only.

10. Community Conduct & Termination

We aim to maintain a respectful and valuable community environment.

We reserve the right to suspend or terminate access to the community and services if a user:

• Violates these Terms
• Disrupts the community
• Engages in abusive, harmful, or inappropriate behavior
• Misuses or shares protected content

Such removal is not intended as standard practice, but may be applied in exceptional cases when necessary.

If access is terminated due to a violation, the subscription will be cancelled automatically, and no refund will be issued.

11. Platform Dependency

The service is hosted on the Skool platform.
We are not responsible for technical issues, outages, or unavailability caused by Skool or other third-party providers.

12. Changes to Content & Service

We reserve the right to:

• Modify, update, add, or remove content
• Change features, structure, or availability of the service
• Temporarily or permanently discontinue the service

Such changes do not entitle users to refunds.

13. Disclaimer & Limitation of Liability

The service is provided on an “as is” and “as available” basis.

To the fullest extent permitted by law:

• We make no warranties, express or implied
• We are not liable for any direct, indirect, incidental, consequential, or special damages arising from use of the service

This includes, without limitation, losses related to decisions, actions, purchases, physical activities, or third-party interactions.

14. Privacy

Your use of the service is also governed by our Privacy Policy, which explains how personal data is collected and processed.

15. No Waiver

Failure to enforce any provision of these Terms does not constitute a waiver of our right to enforce it later.

16. Governing Law & Jurisdiction

These Terms & Conditions are governed by and construed in accordance with the laws of England and Wales.

Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
